Terms of Use and Membership
These terms explain the agreement between you and Toughest Alive in plain language. We want you to know what to expect before you join us.
1. Agreement with Toughest Alive
These Terms of Use and Membership (the “Terms”) apply to ToughestAlive.com, app.toughestalive.com, the Toughest Alive Underground, Underground + Training, event passes, challenges, and related services operated by Toughest Alive, LLC (“Toughest Alive,” “we,” “us,” or “our”). By using the website, creating an account, or purchasing or redeeming access, you agree to these Terms and our Privacy Policy.
2. Who may use the services
You must be at least 18 years old to create and control an account or purchase a membership. A minor may participate only through an account managed by a parent or legal guardian. The parent or guardian is responsible for the minor’s participation, submissions, and compliance with these Terms.
3. Membership choices
The Underground is the primary Toughest Alive membership and costs $39 USD per month. Underground + Training costs $59 USD per month total and includes the Underground plus the optional $20 training add-on. Applicable taxes may be added where required.
Paid memberships are charged when checkout is completed and renew automatically each month on or near the same calendar date until canceled. The price, billing frequency, and selected plan are shown again before payment is submitted.
Eligible event participants may receive a 30-day Event Pass at no charge and without entering a card. An Event Pass includes the access described when it is issued, does not automatically become a paid membership, and may have a redemption deadline, redemption limit, or one-use-per-account restriction.
4. Canceling and managing billing
You may cancel at any time through the Stripe-hosted billing portal linked from the Account page in the member app. Cancellation stops future renewals. Unless we tell you otherwise, your paid access continues through the end of the current paid billing period. If you cannot access the billing portal, email us at toughestalive@gmail.com so we can help.
5. Payments, upgrades, and refunds
Stripe processes paid membership transactions. Toughest Alive does not store complete payment card numbers. Failed or incomplete payments may restrict community and training access while account and billing-management access remains available.
Membership fees are nonrefundable and we do not provide prorated refunds for unused time, except where required by law. If you believe a charge is duplicated, unauthorized, or incorrect, contact us so we can review it. An upgrade may create a prorated charge; the amount is shown before you confirm the upgrade. Any future price change will apply prospectively after reasonable notice.
6. Your account
Keep your sign-in information secure and provide accurate account information. You are responsible for activity under your account. Tell us promptly if you believe your account has been accessed without permission. Accounts and access codes may not be sold, transferred, or shared in a way that defeats membership limits.
7. Showing up together
The Underground is built on honest accountability and generous encouragement. Treat other people with respect. Harassment, threats, hate speech, exploitation, spam, impersonation, unlawful conduct, or sharing another person’s private information is not permitted. We may remove content or suspend or end access when reasonably necessary to protect members, the community, or the service.
8. Content you share
You keep ownership of content you submit. You give Toughest Alive a limited, worldwide, nonexclusive license to host, store, reproduce, and display that content only as needed to operate, secure, and improve the service and to make it visible according to the audience and privacy settings you choose. You are responsible for having the right to share what you submit.
9. Fitness, health, and event notice
Toughest Alive provides general fitness, wellness, accountability, and educational information. It is not medical advice, diagnosis, or treatment. Start where you are, choose an appropriate level, and consult a qualified healthcare professional before beginning or changing an exercise program when appropriate for you.
Physical activity and events involve risk, including injury. You are responsible for deciding whether and how to participate. In-person events may also require separate registration terms, rules, releases, or waivers that apply to that event.
10. Toughest Alive materials
The Toughest Alive name, logos, site design, training materials, challenge formats, videos, photographs, and other materials we provide are owned by Toughest Alive or used with permission. You may use them for your personal, noncommercial participation. You may not copy, sell, publish, or create derivative commercial products from them without written permission.
11. Service availability and disclaimers
We work to keep the services available and safe, but online services sometimes change, pause, or experience interruptions. To the fullest extent permitted by law, the services are provided “as is” and “as available,” without warranties that they will always be uninterrupted, error-free, or produce a particular health, fitness, or performance result.
12. Limitation of liability
To the fullest extent permitted by law, Toughest Alive will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the services. Our total liability for claims related to the services will not exceed the greater of $100 or the amount you paid Toughest Alive during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited, including liability arising from gross negligence or willful misconduct.
13. Changes to the service or these Terms
We may update the services and these Terms as the community grows. If a change materially affects your rights or an active paid membership, we will provide reasonable notice. The updated Terms will show a new effective date. Continuing to use the services after the effective date means you accept the updated Terms.
14. Alaska law
These Terms are governed by the laws of the State of Alaska, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in a state or federal court with jurisdiction in Alaska. Nothing in these Terms limits consumer rights that cannot be waived under applicable law.
